"Truly Shocking:" U.S. Supreme Court Fails to Intervene

This morning, the daddy is feeling angry that the U.S. Supreme Court refuses to intervene in the Troy Davis case. This is one more reason to vote for Obama: so he can put two or three justices on the court who would keep Roe vs. Wade and restore balance and justice to the highest court in our land. "Truly Shocking" October 14, 2008

Amnesty International USA (AIUSA) decried today's U.S. Supreme Court decision to deny a new hearing for Georgia death-row inmate Troy Anthony Davis. The Court had granted Davis a stay of execution just hours before he was scheduled to be put to death while it decided whether to hear the case. In denying Davis' petition for a writ of certiorari, the Court has effectively ended a longstanding battle to have new evidence in Davis' favor heard in a court of law.

"The Supreme Court's decision is truly shocking, given that significant evidence of Davis' innocence will never have a chance to be examined," said Larry Cox, executive director for AIUSA. "Faulty eyewitness identification is the leading cause of wrongful convictions, and the hallmark of Davis' case. This was an opportunity for the Court to clarify the constitutionality of putting the innocent to death –- and in Davis' case, his innocence could only be determined with a new hearing or trial."

"It is disgraceful that the highest court in the land could sink so low when doubts surrounding Davis' guilt are so high," Cox added.

The U.S. Supreme Court denied Davis’ petition for writ of certiorari that was submitted on constitutional grounds of due process and cruel and unusual punishment violations if an individual is put to death despite significant claims to innocence. Davis’ attorneys filed the petition after the Georgia Supreme Court’s narrow 4-3 ruling to deny Davis an evidentiary hearing last March; the ruling was based on technicalities rather than basic questions of guilt and innocence.

Davis was convicted in 1991 of killing Savannah police officer Mark Allen MacPhail. Authorities failed to produce a murder weapon or any physical evidence tying Davis to the crime. In addition, seven of the nine original state witnesses have since recanted or changed their initial testimonies in sworn affidavits. One of the remaining witnesses is alleged to be the actual perpetrator.

Since the launch of its February 2007 report, "Where Is the Justice for Me? The Case of Troy Davis, Facing Execution in Georgia," Amnesty International has campaigned intensively for a new evidentiary hearing or trial and clemency for Davis, collecting well over 200,000 clemency petition signatures and letters from across the United States and around the world. To date, internationally known figures such as Pope Benedict XVI, Archbishop Desmond Tutu and former U.S. President Jimmy Carter have all joined the call for clemency, as well as lawmakers from within and outside of Georgia.

The jury system is too imperfect to ever render a decision of life or death in any case.

torrance: I can't remember what the French social philosopher said about the death penalty. Lately, I've been thinking of George Orwell and how he wrote so insight about the State doing double-speak as it spies on ordinary citizens like hell. But I remember him speaking eloquently about the death penalty. I like the one where he said, "I watched a man die once. There was no question that everyone concerned knew this to be a dreadful unnatural action...It is probably the fact that capital punishment is accepted as necessary, and yet instinctively felt to be wrong, that gives so many descriptions of executions their tragic atmosphere."

The huge rusty gears of justice in the south will not be slowed in this case, even while the truth is ground to pieces in the racist machinery. A very sad commentary on justice in the 21st century. Guilt beyond a doubt daddyBstrong does not enter this equation.

This same exact unjust situation was happening in our Southern States when poor and mostly uneducated Black Americans were being falsely imprisoned for endless decades without the needed educational skills to properly submit their own written federal trial appeals.

This devious and deceptive judicial process of making our poor and innocent prison inmates formulate and write their own federal appeal legal cases for possible retrials on their state criminal cases,is still in effect today even though everyone in our US judicial system knows that without proper legal representation, these tens of thousands of innocent prison inmates will be denied their rightful opportunities of ever being granted new trials from our federal appeal judges!!

Sadly, the true US *legal* Federal Appeal situation that occurs when any of our uneducated American prison inmates are forced to attempt to submit their own written Federal Appeals (from our prisons nationwide) without the assistance of proper legal counsel, is that they all are in reality being denied their legitimate rights for Habeas Corpus with our US FEDERAL COURTS and will win any future Supreme Court Case concerning this injustice!

For our judicial system and our US Congressional Leaders Of The Free World to continue to pretend that this is a real and fair opportunity for our American Middle Class and Working Poor Citizens, only delays the very needed future change of Federal Financing of all these Federal appeals becoming a normal formula of Our American judicial system.
